Policies

This Rental Agreement is made by and between Legacy Vacations, Inc. and the primary registered guest noted in the Reservation Confirmation. It is understood that the registered guest is the accountable party for all guests staying in the rental property at any time through the duration of their confirmed stay dates including any persons invited into the property by the registered guest or the other occupants of the rental property. By making a reservation with Legacy Vacations, Inc., the guest acknowledges and agrees to the following policies which comprise a legally binding contract between Legacy Vacations, Inc., and the guest.
    1. Definitions. As used herein, the terms “Legacy”, “we”, “our”, “us” shall mean and refer to Legacy Vacations, Inc. and its employees, officer, and agents. The terms “guest”, “you”, or “your” shall refer to the primary gust listed on the reservation documentation and all other persons staying/residing/visiting the rental property during the confirmed stay dates.

    2. Requirement for stay. You will NOT be permitted to check in unless and until we have received your signed acknowledgement of our rental policies.

    3. Reservations. Acceptance of your reservation is predicated on our review of your request for compliance with all requirements of the property, which may include, but not limited to, minimum nights required, advanced reservation payment, number of occupants and other conditions applicable for the specific rental property.

      Your reservation shall be considered confirmed when we send you a Reservation Confirmation email, which will be sent electronically to the email address provided by you at the time of booking. This email will be sent after our receiving and posting your advanced payment to your reservation folio and upon sending, the reservation is subject to the Legacy cancellation policy.

      If at any time your reservation does not meet the requirements and conditions for renting the subject rental property, Legacy Vacations, Inc. reserves the right to cancel your reservation and refund the initial payment you made.

    4. Cancellation Policy. Once confirmed, your reservation is subject to the following cancellation policy:

      (a) 30 days or more prior to check-in. In the event you choose to cancel your reservation 30 or more days in advance of your check-in date, you will receive a refund LESS the (i) service fee and (ii) any travel insurance premium along with any applicable taxes on the forgoing.

      (b) 29 days or less before check-in. In the event you choose to cancel your reservation less than 30 days in advance of your check-in date, you will receive a refund for any prepaid cleaning fees only. All other monies paid will be forfeited.

    5. Travel Insurance. Travel Interruption insurance is available through CSA Travel Insurance and is offered as an option to anyone booking with Legacy Vacations. You are strongly encouraged to take advantage of this option as no refunds will be given outside of the cancellation policies noted in this agreement. The non-refundable travel insurance premium is 6.95% of the pre-tax total of your reservation and the premium is non-refundable. This protection, if purchased, provides for the reimbursement for non-refundable payments if your trip must be cancelled.     6. Advanced Reservation Payments and Payment of Rent. All reservations booked with Legacy Vacations require an advanced payment of $250 to confirm the reservation. If you elect the optional travel insurance, the premium for the insurance is due at the time of booking, in addition to the advanced payment. Final Payment for the outstanding balance of your reservation is due 30 days prior to arrival. We will automatically charge the remaining balance to the credit card on file for the reservation.

      Any reservation made under false pretense and/or any reservation remaining unpaid for 3 days after the payment deadline, per the above Payment of Rent outline, is subject to immediate cancellation and forfeiture of all monies paid.

    7. Property election/assignment. We will make every effort to honor the particular property you reserved. However, in the event of unforeseen circumstances or circumstances beyond our control, there may be times where we are unable to honor a specific unit or property request. It is understood that no unit assignment, even when confirmed, are guaranteed. It is further understood and agreed that in such event that a unit assignment must be changed, we will use all reasonable efforts to provide accommodations substantially like what was originally booked.

    8. Check-in Time. Check-in begins after 4pm local time. Please keep in mind that there are many variables that may delay your check-in that are simply beyond our control. We will use our best efforts to ensure that we get you into your rental as quickly as possible but suggest that you plan your arrival accordingly. Your patience is greatly appreciated. Please be advised that there will be no discounts offered for delayed or late check-ins.

    9. Check-out time. Check out time is no later than 10am local time. On checkout day, guests are asked to put all dirty dishes in the dishwasher and start the dishwasher and to remove all trash from the unit. There is no need to strip beds, etc. We also ask that you click the checkout link that will be sent to you via text message when you vacate the unit. This will notify our housekeeping teams that the unit is vacant and ready for service and will go a long way toward helping us meet the 4pm check in time.

    10. Housekeeping Fee. All our rental units require a one-time departure cleaning fee to be paid by the guest to cover the cost of cleaning upon your departure. This fee is subject to all state and local sales taxes. We make every effort to ensure that each of our properties is cleaned after each checkout. IF YOU HAVE ANY ISSUES OR PROBLEMS, PLEASE REPORT THEM TO THE LEGACY VACATIONS STAFF WITHIN 24 HOURS OF ARRIVAL SO WE MAY ATTEMPT TO RESOLVE THEM IN A TIMELY MANNER. NO DISCOUNTS, REFUNDS OR CREDITS WILL BE GIVEN DUE TO HOUSEKEEPING ISSUES.

    11. Maintenance Services. Should you have any maintenance issues arise during your stay, please promptly report these instances to Legacy Vacations. We will use all reasonable efforts to remedy the issue(s) as quickly as possible. No refunds or credits will be provided for issues or system failures that are beyond our control.

    12. Property Rules and Regulations. In most cases, your rental unit is in a larger development or association. Each association has adopted their own specific property rules and regulations, which may include such mandates as parking passes, pool/property wristbands, amenity hours of operation, quiet hours, and other similar regulations. These rules apply to owners and guests the same. Failure to abide by an association’s rules and regulations may result in fines and/or eviction from the property. We are unable to provide any refunds or credits in the event of you being fined or evicted by the association.

    13. No Subletting. Your reservation with Legacy Vacations, Inc. is not assignable or transferrable and subletting is strictly forbidden. Any attempts to sublet the property will result in immediate cancellation and the forfeiture of all monies paid.

    14. No Smoking. Smoking/vaping in the units or on the balconies is prohibited. Smoking permitted in designated areas only. Violations of this policy will result in a $250 penalty charge to the credit card on file.

    15. No Pets Please. Sorry, we are unable to accommodate pets at any of our properties. The only exception is for ADA (American Disabilities Act) qualified animals. ADA-qualified animals must be declared prior to your arrival. You can reach out to us for additional information. Violation of this policy will result in a $350 penalty charge to the credit card on file or eviction.

    16. Parking. Parking at most complexes is limited per individual association rules. Where required, you will be furnished parking passes that must be displayed on the vehicle’s dash at all times while on the respective association’s property.  Under no circumstance are boats, trailers or RV's permitted to park at any complex at any time during your stay.

    17. Personal Property. Legacy Vacations is not responsible for any acts of theft, vandalism, or other damages to any personal property. Additionally, Legacy Vacations is not responsible for and has no obligation to store any personal items left by the guest upon departure and as such, may dispose of such property without notice, consent, or liability.

    18. Occupancy Limits. Each unit’s occupancy is capped at the number of people the unit’s bedding will accommodate. Over occupancy is grounds for eviction.

    19. Hold Harmless. You agree to hold Legacy Vacations, Inc., and the property owner harmless from and against all claims, demands, causes of action, damages and liability arising from or related to any of the following: 

      (a) Any plain and visible defective condition of the rental property or any furniture, fixtures, or equipment therein not promptly reported to Legacy upon your check-in (prompt reporting means within eight (8) hours from the time you check-in to the property). 

      (b) Any unknown defective condition of the rental property or any furniture, fixtures, or equipment therein.

      (c) Any actions or conduct, or failures to act, whether negligent or intentional, on your part or on the part of any third party resulting in personal injury, harm, or death to you or any other persons. 

      (d) Any injury, harm, or death to you or any other guest, persons, or animals during your stay not caused by us, including any injury, harm, or death caused by any defective condition of or in the property or to furniture, fixtures, or equipment (including any swimming pool, deck, dock, pier, or balcony).

      (e) Any and all damage to the rental property or any furniture, fixtures, or equipment (including any swimming pool) in or serving the property as a result of your, or any other occupants, negligent or intentional acts, conduct, or negligent or intentional failures to act. 

      (f) Reasonable differences and/or changes between the property’s actual condition at check-in and the condition represented on our website advertising or in our marketing materials, photographs, or other descriptions used on our website or as part of our online internet reservation system as a result of remodeling, maintenance, normal wear and tear, or similar circumstances beyond our control. 

    20. Agent for the Owner. Legacy Vacations, Inc. serve as the agent for the owner of the rental property.

    21. Digital signatures. By completing and submitting your reservation you are acknowledging and agreeing to all the terms and conditions of this agreement. Additionally, you acknowledge and agree that all digital signatures, digital initials, acknowledgement checkboxes, and the like are legally binding on you and all guests residing in the rental property during your stay.

    22. Governing Law, Venue and Jurisdiction.You agree and acknowledge this Agreement is made and entered in Okaloosa County, Florida and shall be governed by and construed under the laws of the State of Florida without regard to any conflict of law provisions. Venue and both subject matter jurisdiction and personal jurisdiction of all parties will lie exclusively in the Circuit Court in and for Okaloosa County, Florida.

    23. Binding Agreement. You acknowledge and agree that this agreement is a binding legal contract that you have read and agree with all terms and conditions herein.
